Cecil Floyd Wins Defense Verdict In Case Where Jury Awards $28 Million Against Other Defendants
After a four week trial in Supreme Court, Westchester County, Cecil Floyd secured a defense verdict in Gloria G. v. City School District of the City of Mount Vernon et al. Index No. 70026/12. The case involved allegations of sexual assault, bullying and physical assault of a special needs high school student. Mr. Floyd represented a bus company that transported students to and from the school.
Following a five hour deliberation, the jury held the co-defendant school district 99% responsible and one of the alleged assailants 1% liable for plaintiff’s claimed injuries and awarded $28 million to the plaintiff. Mr. Floyd argued that the bus company did not breach any duty owed to the student, that none of the alleged incidents occurred while the student was in the bus company’s custody and no proximate cause. As a result, the jury found the bus company was not negligent.
