Cecil Floyd and Audrey Medd Win Unanimous Defense Verdict
Partner, Cecil Floyd, Esq. and Senior Associate Attorney, Audrey D. Medd, Esq. recently were awarded a unanimous defense verdict in the matter of PUE, JAMES L. Et Al v. JIMMIE'S, INCORPORATED, NNH-CV21-6111850-S, venued in New Haven Superior Court, in the State of Connecticut and tried before Judge Karen Goodrow in New Haven Superior Court in the State of Connecticut.
In this matter, the plaintiff alleged that, as a result of a slip and fall on water in the defendant’s restaurant, he sustained multiple injuries including a Traumatic Brain Injury, spinal cord damage, cervical myelomalacia and a displaced orbital fracture. The plaintiff claimed that the defendant created the alleged condition by mopping the floor while patrons were still in the restaurant, failed to post a warning sign, and failed to perform a proper inspection of the area. The defendant contended that there was no water condition and that, instead, the plaintiff tripped as a result of a pre-existing spastic gait.
The defendant also argued that the plaintiff’s spinal cord damage was the result of a pre-existing congenital Os Odontoideum, not his fall, and that the TBI was mild with no evidence of damage to the white matter of the brain.
In closing arguments, the plaintiff’s counsel suggested an award of over $23 million in damages. After nearly four hours of deliberation, the jury found unanimously in favor of the defendant, Jimmies, Inc., also known as Jimmies of Savin Rock, an iconic landmark restaurant located in West Haven, Connecticut.
