Matthew J. Shock Wins Summary Judgment on Behalf of Tenants for Alleged Defective Sidewalk Outside Premises

Matthew J. Shock successfully obtained summary judgment dismissing all claims against the Firm’s client, a commercial tenant, alleged to have been responsible for a defective sidewalk outside the premises. Plaintiff alleged that he was seriously injured after tripping and falling on a defective sidewalk outside the premises. Through Mr. Shock’s written motion, followed by subsequent oral argument, the court was convinced that the Firm’s client was not negligent as a commercial tenant. The court agreed that no evidence was produced demonstrating that the tenants had a duty to repair or replace the sidewalk, nor were responsible for such defect. The case continues against the remaining defendants.
