Audrey Medd Wins Motion to Dismiss in Connecticut Superior Court
Congratulations to our Senior Associate, Audrey Medd, for winning a Motion to Dismiss for one of our firm’s clients. Audrey appeared for oral argument in Connecticut Superior Court, Judicial District of New Haven before the Honorable Justice James Wilson Abrams where she successfully argued the motion in favor of our client.
In Jackson v. 61 Warwick, LLC, et. al. Audrey successfully demonstrated that the Court was without jurisdiction because the individual defendant was not served properly. Specifically, she argued that the plaintiff did not serve the individual defendant at his "last known address" as a nonresident individual as required by Connecticut General Statutes § 52-59b(c). The plaintiff argued that despite improper service, the individual defendant still received notice. Judge Abrams rejected the plaintiff’s argument, holding that service was insufficient to satisfy the dictates of the statute and, as a result, granted the motion to dismiss as to the individual defendant.
