David Gould and Svitlana Astakova Get A Unanimous Defense Verdict on Liability and Damages
David Gould and Svitlana Astakova obtained a unanimous defense verdict in the Civil Court Queens County before Judge Alan J. Schiff in the Pierre Laine v. Iga Trojanowski, Jean Dorismond and Harold Almonor case, Index TS-350535/19. The plaintiff, Pierre Laine, was a front seat passenger in our client Jean Dorismonds’ car on January 15, 2016. Dorismond was heading eastbound on Jericho Turnpike while co-defendant Iga Trojanowski was heading northbound on 10th Street in New Hyde Park. We argued that the co-defendant was negligent for failing to yield right of way when she was facing a stop sign. Co-defendant’s attorney argued that her car was stopped waiting for Dorismond to pass her vehicle when he moved into her lane of traffic. With respect to damages the plaintiff underwent a right shoulder arthroscopy. The defense argued that the surgery was not caused by this car accident.
After 1 hour and 7 minutes the jury found that Dorsimond was not negligent and that co-defendant Trojanowski was negligent as well as the proximate cause of the accident. The jury found that the plaintiff did not sustain a serious injury and thus did not award plaintiff any compensation.
